Everything that is forbidden

Starting this summer, it is forbidden to sell cigarettes and other tobacco products through delivery trade, as well as in stalls and kiosks; the exception is those settlements where there is not a single shop or pavilion. In addition, cigarettes cannot be sold by door-to-door sales or remotely. The sale of tobacco products through vending machines is also prohibited.

The law also imposes restrictions on places where tobacco products are sold. As before, cigarettes cannot be sold on the territories of schools, universities and other educational institutions and within a range of one hundred meters from the borders of their territories, as well as in the territories and premises of railway stations, airports (except for duty-free shops), hospitals, clinics and other medical institutions. In addition, the sale of tobacco products is prohibited in the premises of hotels and public authorities and administration, on all types of public transport in urban and suburban communications. The law does not provide for a ban on the sale of tobacco products on long-distance or international transport.

How can you sell cigarettes now

With the exception of localities where there are no shops or pavilions, cigarettes can only be sold in shops or pavilions. A pavilion or shop cannot be located on a territory or inside a facility where the sale of tobacco is prohibited. For example, if a store is less than a hundred meters from a university, it is not allowed to sell tobacco products there.

With regard to the organization of sales, from June 1, 2014, the display and demonstration of tobacco products in a retail facility is limited. That is, when entering the store, the buyer should not see, as before, the exposed packs or blocks of cigarettes and cigarettes. Demonstration of tobacco products is allowed at the request of the buyer after he has familiarized himself with the list of tobacco products offered for sale.
Mandatory requirements are introduced for the list of tobacco products: it is made in letters of the same size in black on a white background and compiled in alphabetical order without the use of graphic images and drawings. In the list, in addition to the names, prices for tobacco products offered for sale should be indicated. The law also does not prohibit supplementing the list with other information related to tobacco products. This, for example, can be the characteristics of tobacco products (nicotine content, tar content). Such information should not be considered as advertising.

The law does not regulate the procedure for displaying tobacco products at the request of the buyer. The point of sale has the right to independently determine how exactly tobacco products will be displayed. So, at the request of the buyer, tobacco products can be demonstrated by the seller himself, or special trade equipment can be used. It should be noted here that the seller has the right to demonstrate one pack, several packs, or all available names of tobacco products, depending on what the buyer specifically requested. At the same time, when opening the equipment in which the products are stored, the buyer a short time not only the products that he asked to be shown to him, but also other packs can be seen.

Also, the Law does not prohibit the seller from informing the buyer about the characteristics of the product in accordance with consumer protection legislation: under the consumer protection law, the seller is obliged to provide the consumer with the necessary and reliable information about the goods in a timely manner, ensuring the possibility of their correct choice. Moreover, such information should be provided to the buyer before the sale of the goods. Therefore, the buyer has the right to get acquainted with the available products and their characteristics for as long as he needs, and the seller has no right to limit him in this.

How can you promote a new product?

It must be remembered that in Russia since November 15, 2013, when the law on advertising was changed, there has been a ban on advertising of tobacco products. The law also introduced a number of bans on the promotion of tobacco products. Thus, the sale of cigarettes at a discount and the free distribution of tobacco products to the population, including in the form of gifts, are prohibited.

You cannot hold events (lotteries, contests) with prizes in the form of tobacco products or the condition for participation in which is the purchase of tobacco products. In general, any cultural, sports and other public events should not encourage the purchase or use of tobacco products. You cannot apply tobacco trademarks (brands, "trade marks") on any non-tobacco products (cups, T-shirts, etc.). Prohibited and retail tobacco products packed in one consumer container with goods that are not tobacco products (a set of cigarettes and lighters, etc.). Accordingly, the opportunities for promoting tobacco products on the market today are significantly limited.

In addition to Rospotrebnadzor, the police may be held liable for violating the ban on the free distribution of tobacco products.

When can an audit be carried out?

Rospotrebnadzor is authorized to check compliance with the rules for the sale of tobacco products, as well as compliance with the ban on promoting the sale and consumption of tobacco products. As with other issues within the competence of Rospotrebnadzor, verification of compliance with restrictions on the sale of tobacco products may be scheduled or unscheduled.

Scheduled inspections are carried out in accordance with the plan posted on the website of the relevant government agency, as well as on the website of the Prosecutor General's Office. So, on the website of Rospotrebnadzor, you can check whether a particular organization will be checked in 2014. Scheduled inspections should not be carried out more frequently than once every three years. The inspecting state body is obliged to notify the person of the upcoming inspection within three working days before it begins, by sending a copy of the order to conduct the inspection.

Unscheduled inspections can be carried out only in certain cases. In particular, such an inspection can be carried out in a store whose deadline for fulfilling an order to eliminate violations based on the results of a previous inspection has expired, as well as if applications have been received in relation to the store from citizens or legal entities, there were reports in the media about the possible harm to the life and health of citizens, environment. An unscheduled inspection may also be appointed on the basis of the request of the prosecutor based on the materials received by him.

The main document regulating the conduct of the audit is the order (order) on its conduct. In addition to the name of the legal entity and the inspection body, such an order must indicate the officials authorized to conduct the inspection and the purpose of the inspection. This means that the store may not provide documents and other information to officials not specified in the order. In addition, before the start of the inspection, you need to make sure that the order is signed by the head or deputy head of the inspection body.

How should it be carried out

By general rule, the audit must be carried out in the presence of the head of the audited organization. If the head is not in place, another authorized representative can replace him, who, on the basis of a power of attorney, job description, internal order or other document has the right to represent the store in the framework of inspections. It must be borne in mind that Rospotrebnadzor can conduct an inspection even in the absence of the head and other authorized persons, if the organization being inspected has been duly notified of the upcoming inspection.

An inspection without the presence of a manager or an authorized person can also be carried out if it takes place unscheduled in connection with the receipt by the state agency of information about a case of harm to the life or health of a citizen, harm to the environment (such a basis for conducting an inspection should be indicated in the order on its conduct).

The verification period is usually 20 working days and may be extended by another 20 working days if there are appropriate grounds. Small businesses must not audit more than 50 business hours (with an option for an additional 15 hours) in a year.

Based on the results of the check, an act must be signed, a copy of which must be provided to the person being checked. Also, based on the results of the inspection of the organization, an order to eliminate the detected violations can be issued. If the administration does not agree with the facts or conclusions given in the act or in the prescription, it can send its objections to the inspection body within 15 days.

If during the inspection any violations were found, on the basis of the act, a decision on bringing to responsibility may be issued. The ruling may be appealed in court within 10 days from the date of receipt of its copy.

Measures of state influence on the price level of tobacco products are carried out through the establishment of minimum and maximum retail prices for such products. By virtue of par. 11 p. 1 art. 9 of the Federal Law of December 22, 2008 No. 268-FZ “Technical Regulations for Tobacco Products” (hereinafter referred to as the Technical Regulations), information on the maximum retail price in rubles must be applied to the consumer packaging of tobacco products, according to which on one of the outer sides each consumer package (pack) of cigarettes and cigarettes must be applied:

By virtue of h. 2 Article. 187.1 of the Tax Code of the Russian Federation, the maximum retail price is the price above which a unit of consumer packaging (pack) of tobacco products cannot be sold to consumers by retailers, Catering, the service sector, as well as individual entrepreneurs; the maximum retail price is set by the taxpayer independently for a unit of consumer packaging (pack) of tobacco products separately for each brand (each name) of tobacco products.

There it is defined that a brand (name) for the purposes of this chapter means an assortment item of tobacco products that differs from other brands (names) by one or more of the following features - an individualized designation (name) assigned by the manufacturer or licensee, recipe, size, presence or absence of a filter , packaging.

Maximum retail price represents the price above which one pack of tobacco products cannot be sold to consumers by retailers, public catering, services, as well as individual entrepreneurs. (see clause 2 of article 187.1 of the Tax Code of the Russian Federation)

Thus, minimum retail price= 75% of the maximum retail price.

The sale of tobacco products below the maximum retail price indicated on the product package (by no more than 25%) does not form part of Art. 14.3.1 of the Code of Administrative Offenses of the Russian Federation - sponsorship of tobacco or promotion of the sale of tobacco.

Overstatement by a retail (wholesale) seller of the maximum retail price indicated by the manufacturer of tobacco products on each package (pack) of cigarettes shall entail the imposition of an administrative fine:

  • for citizens in the amount of 5000 rubles.
  • for officials - 50,000 rubles. or disqualification for up to three years
  • for legal entities - in the double amount of excessively received proceeds from the sale of tobacco products for the entire period during which the offense was committed (but not more than one year) (clause 1 of article 14.6 of the Code of Administrative Offenses of the Russian Federation)

When using IP on UTII

Tax legislation does not allow using UTII when selling excisable goods listed in subparagraphs 6-10 of paragraph 1 of Article 181 of the Tax Code of the Russian Federation. So it is necessary to withstand the seeds for several days, while stirring them five to six times a day and constantly moisten them. In this case, the air temperature should be about 28 degrees.

Seeds should be sown in a greenhouse with a nutrient layer, which consists of ¾ of humus and ¼ of sand. The layer should be 10 cm thick. It should be borne in mind that the seeding rate for tobacco is 4 grams of seeds per 10 sq.m., and shag - 20 g. Tobacco should be planted at a depth of 0.3 cm, and shag - 0.7 cm.

The planting of germinated seeds takes place in February-March, of course, that the greenhouse must be heated. The greenhouse does not take up much space, just a few square meters are enough.

Before planting seeds and after this process, the nutrient layer must be moistened. This is done on the basis of the calculation - one liter of water per square meter. As the plant grows in growth, its watering is increased to 4 liters per square meter. It is important to note that the temperature must be reduced from 27 to 20 degrees. While the seedlings are growing, it must be sprinkled three or four times.

Seedlings require feeding. It is carried out using a solution prepared from ammonium nitrate, superphosphate and potassium salt (for ten liters of water you will need: 30 g of nitrate, 20 g of potassium salt and 50 g of superphosphate). Feed should be two liters of solution per square meter.

Do not forget also about organic top dressing. Here you can use fermented chicken manure, which is diluted with water in a ratio of 1: 7.

A week before transplanting seedlings into open ground, watering is significantly reduced, both in intensity and volume. In the last three days, seedlings have not been watered at all.

If you want to check the quality of your seedlings, then the sign of a good plant is an elastic stem that does not break when bent. A few hours before transplanting, seedlings are watered abundantly. This makes it easy to extract it from the ground. A plant ready for transplanting should have a stem 15 cm high and half a centimeter thick.

Tobacco can be transplanted into open ground only if the soil at a depth of 10 cm has already warmed up to 10 degrees. Of course, in various climatic conditions, the transplant time will vary from mid-April to mid-May.

It is necessary to plant seedlings at a distance of about 25-30 cm from each other, while the row spacing should not be less than 70 cm. Before planting seedlings, half a liter of water is poured into each well, and the roots of the plant are dipped in a mixture of clay and cow dung .

Plant care consists in the systematic loosening of row-spacings, top dressing and weeding. The plant will not need to be watered often.

For the entire growing season, it will only be necessary to water two or three times, while expecting about 8 liters of water per plant. After flowering begins, it is necessary to pinch the plants.

What diseases can be encountered while growing tobacco? Among the most common are downy mildew and aphids. Peronosporosis is fought with a solution of a 0.4% suspension of "Cineba" or a 0.3% solution of "Polycarbacin".

If we talk about aphids, then “Rogor” or “Atelik” is used against it, which is simply used to treat plants.

Now let's go directly to harvesting, that is, harvesting the leaves and drying them. Tobacco leaves begin to be removed from the lower tiers, immediately after they turn yellow. It should be said that at the same time they should not be damaged or dry.

After that, the removed leaves are placed in the shade, laying in layers of 30 cm. Thus, they are kept for 12 hours so that the leaves wilt a little. Then the leaves are placed on cords and dried. To dry the leaves, it is necessary to choose a suitable place, it must be sheltered from both rain and wind.

Sunny weather contributes to a faster drying procedure, which takes place in just two weeks.

After the leaves are dried, they are hung in small batches (5-6 cords) on a havanka - a special hook. Havankas are placed indoors, where the leaves continue the drying process. Hooks are hung on the crossbars.

When autumn comes, the leaves are removed, then smoothed and stacked in piles.

In order to obtain fragrant tobacco for cigarettes from tobacco leaves, it is necessary to ferment dry leaves.

For such a process, it is necessary to warm the prepared leaves (for three days) in a tightly closed container at a temperature of 50 degrees and at a humidity of 65%. After that, it is necessary to keep the leaves at a humidity of 75% for another week, and for another two days, lowering the temperature and raising the humidity to 80%. After that, the leaves should be cooled to room temperature in three days, and their humidity should be 11-16%. After a similar procedure, the leaves are sent to rest for a month.

Ready tobacco is cut into strips half a millimeter wide. For a regular cigarette, one gram of tobacco is required. It is believed that quality cigarette tobacco should consist of a mixture of different varieties, at least two of them.

If we talk about shag, then it is better to add fragrant sweet clover, or any other aromatic natural additive.

Well, actually, let's talk about the profitability of such a business. Let, for example, we have a land plot of 10 acres, which we will use for growing tobacco.

It was said above that, for planting a square meter, 0.4 g of seeds are needed, that is, for planting 1000 square meters. m will require 400 g. Makhorka at retail costs 1500 rubles, and Virginia tobacco - 1900 rubles. That is, for sowing ten acres, we will need either 76 thousand to buy seeds of the Virginia variety, or 60 thousand rubles to buy seeds of shag.

Given that the output per hectare of first-class tobacco will be 2-3 tons, which means that from 10 acres - 200-300 kg of tobacco, and shag - 300-400 kg.

You can sell shag in bulk for 400-500 rubles per kg, it turns out that the gross income will be 200 thousand rubles, while the net income will be 140 thousand. With tobacco, the situation is much more interesting, but here it should be taken into account that the requirements for this product are higher, and it costs more. So, if you estimate that wholesale tobacco can be sold at 2,000 per kg, then the gross income here will be 600,000, while the net income is 524,000 rubles. Agree, a lot.
